FOSS Data Terms of Use

IMPORTANT — PLEASE READ CAREFULLY. BY ACCESSING OR USING THE FOSS DATA WEBSITE, RESEARCH, VISUALS, REGISTRATION SERVICE, OR REPORT SERVICE (TOGETHER, THE “SERVICE”), YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.

These Terms govern the FOSS Data research and report service published by Exodos Labs, Inc. (“Exodos”, “we”, “us”). They do not govern the separate Exodos Labs platform at app.exodos.io.

Research and report access

Exodos grants you a limited, non-exclusive, non-transferable, revocable permission to access the Service and use its public research, findings, diagrams, and registered report-delivery features in accordance with these Terms and the published data-reuse rules.

If you register for report access, you must provide accurate, current information, keep access credentials and one-time codes confidential, and promptly notify Exodos of suspected unauthorized access. You are responsible for activity conducted through your account or access session.

Acceptable use

You must not:

• use the Service or its content unlawfully or to infringe third-party rights;
• interfere with or disrupt the Service, bypass access controls, probe non-public systems, or introduce malware or harmful code;
• use automation in a way that imposes an unreasonable load or defeats technical restrictions;
• misrepresent FOSS Data research, findings, data, or diagrams, or imply endorsement by Exodos; or
• remove notices, provenance, source qualifications, or required attribution from reused materials.

Intellectual property and attribution

The Service, site design, original text, and original visual presentation remain the property of Exodos and its licensors. Exodos does not claim ownership of third-party source data, which remains subject to its applicable source terms and licensing requirements.

Unless a specific item states otherwise, charts and visual analyses published by FOSS Data may be reused free of charge only with this attribution:

Keep the attribution reasonably prominent and associated with the reused data, chart, diagram, or visual. Item-specific source notes, trademarks, licenses, and reuse restrictions take precedence and must remain intact. The downloadable visual kit and its manifest provide reusable files and item-level attribution details.

Privacy

The FOSS Data Privacy Policy explains how personal information is collected, used, disclosed, protected, and retained in connection with the Service. Using registration or report delivery requires the affirmative acceptance captured during that flow.

Availability

The Service is provided “AS IS” and “AS AVAILABLE.” Exodos may change, suspend, or discontinue any part of the Service and does not promise uninterrupted availability, support, or a service level. No system can be guaranteed to be completely secure.

Research and security-data disclaimer

FOSS Data content is informational research based on identified sources, methods, assumptions, and snapshot dates. It may contain errors, omissions, estimates, inferred attributes, or information that becomes outdated. It does not represent every open-source project or ecosystem and is not legal, compliance, investment, or professional security advice.

Findings about vulnerabilities, maintainers, contributors, organizations, geography, provenance, packages, or supply-chain risk do not establish that any person or organization acted improperly. You remain responsible for independent verification and for decisions made using the Service. Exodos does not warrant that the research will identify every vulnerability, dependency, license issue, threat, or compliance obligation.

Limitation of liability

To the fullest extent permitted by law, neither Exodos nor its licensors will be liable for indirect, special, incidental, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity arising from the Service or its content. Exodos’s total liability arising out of the Service is limited to the fees, if any, that you paid directly for use of the FOSS Data Service during the twelve months preceding the claim.

Nothing in these Terms excludes liability that cannot lawfully be excluded or limited.

Termination

Exodos may suspend or terminate access for a material breach, unlawful use, security risk, or interference with the Service. You may stop using the Service at any time. When access ends, your permission to use restricted Service features ends, but provisions concerning attribution, intellectual property, disclaimers, liability, governing law, and accrued rights survive.

Governing law and disputes

If you are domiciled in North America, Delaware law governs these Terms without regard to conflict-of-law rules. Otherwise, German law applies. Courts in the applicable venue have exclusive jurisdiction, except where mandatory consumer law requires otherwise.

Changes to these Terms

Exodos may update these Terms to reflect changes to the Service, law, or operations. The published version and effective date identify the Terms currently in force. Material changes will be communicated through an appropriate Service channel before they take effect when required by law.
